1. The agreement
These Terms of Use ("Terms") form a legal agreement between you ("you") and Osara Book ("Mizan," "we," or "us"), the publisher of the Mizan mobile application (the "App"). By downloading, installing, or using Mizan, you agree to these Terms. If you do not agree, please do not use the App.
If you obtained Mizan through the Apple App Store or Google Play, the platform's own end-user license terms also apply and take precedence over these Terms for any conflicting clauses required by the platform.
2. License to use Mizan
We grant you a personal, worldwide, royalty-free, non-exclusive, non-transferable, revocable license to install and use Mizan on devices you own or control, for your own personal and non-commercial use, subject to these Terms and the rules of the app store you obtained it from.
You may not: (a) copy, modify, distribute, sell, or lease any part of the App; (b) reverse-engineer or attempt to extract the source code, except to the extent that applicable law forbids restricting such activities; (c) remove or alter any proprietary notices or branding; (d) use the App in any way that violates applicable laws.
3. Acceptable use
You agree to use Mizan only for lawful, personal money-tracking purposes. You are responsible for the accuracy of the data you enter into the App. You must not use Mizan to record or facilitate any illegal activity.
Mizan is intended for users aged 13 or older (or the equivalent minimum age in your jurisdiction). By using Mizan you confirm that you meet this minimum age.
4. Your data
Mizan stores all of the budget data you enter locally on your device. We do not operate servers that store your transactions, envelopes, sinking funds, debts, or notes. Because of this, you are solely responsible for backing up and protecting your device. If you uninstall the App or lose your device, your data cannot be recovered by us.
Our handling of any data is described in detail in the Privacy Policy, which is incorporated into these Terms by reference.
5. Optional iOS tips
On iOS, Mizan offers a voluntary "tip jar" powered by Apple's In-App Purchase system. Tips are entirely optional, are processed by Apple, and are non-refundable by Mizan. Tips are consumable — they do not unlock any feature, additional content, or premium tier. The App will continue to work identically whether or not you ever leave a tip.
If you believe a tip was charged in error, please contact Apple Support; refunds for App Store purchases are handled exclusively by Apple.
6. Not financial advice
Mizan is a personal organisational tool. The App, including its envelopes, sinking-fund tracking, debt-snowball simulator, and insights, is provided for informational purposes only. Nothing in the App constitutes financial, investment, tax, accounting, or legal advice. Always consult a qualified professional before making significant financial decisions.
7. Warranty disclaimer & limitation of liability
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VULNERABILITIES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OSARA BOOK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR FINANCIAL OUTCOMES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF — OR INABILITY TO USE — THE APP. OUR TOTAL CUMULATIVE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF TIPS YOU PAID TO US THROUGH APPLE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) USD 10.
Some jurisdictions do not allow certain limitations of warranties or liability; in those jurisdictions, the above limitations apply only to the extent permitted by law.
8. Availability of the App
We may, at our sole discretion and without notice, update, change, suspend, or discontinue Mizan or any of its features. We will make reasonable efforts to give meaningful notice of changes that materially affect existing users.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of Mizan after the change becomes effective constitutes acceptance of the revised Terms. If the change is material, we may also surface a notice within the App.
10. Termination
You may stop using Mizan at any time by uninstalling the App from your device. We may terminate or suspend your right to use Mizan if you materially breach these Terms. Sections regarding ownership, warranty disclaimers, liability limitations, and governing law survive any termination.
11. Intellectual property
Mizan, the Mizan name and logo, the visual design, and all software comprising the App are owned by Osara Book and protected by copyright, trademark, and other intellectual-property laws. These Terms do not grant you any right to use our trademarks or branding outside of normal use of the App.
12. Governing law & disputes
These Terms are governed by the laws of the Sultanate of Oman, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms or the App shall be resolved in the competent courts of Muscat, Oman, unless mandatory consumer-protection laws in your country grant you the right to bring the dispute in a local court.
13. Apple App Store additional terms
If you downloaded Mizan from the Apple App Store, you acknowledge that these Terms are between you and Osara Book only, not with Apple. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App to you. Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.
